DELEGATES’ AGREEMENT FORM
TO BE CONSIDERED FOR PARTICIPATION IN AMERICAN SPIRIT PAGEANTS ALL PROSPECTIVE DELEGATES, AND THE PARENTS/GAURDIANS OF MINOR PROSECTIVE DELEGATES, MUST SIGN THIS FORM INDICATING AGREEMENT WITH THE TERMS HEREIN

I enter this agreement with American Spirit Pageants, Inc. its representatives, and/or assigns (“ASP”) and if selected as a State Delegate via state pageant or “At Large” selection process I hereby agree to the following:
Morality Statement
1. I meet the eligibility requirements for my Division. If at any point during my reign I no longer meet the eligibility requirements (E.g. a Miss or Ms. gets married or a Mrs. gets a divorce) it is in the sole discretion of ASP to disqualify me and strip me of my title.
2. I am not now, nor have ever, posed nude for any print or video media or been involved in any sexually graphic materials as a model or actress. In the alternative, I have disclosed such involvement to the American Spirit Pageant national office for a determination as to my eligibility and accept their decision without question or argument. Failure to disclose this information may result in disqualification and relinquishment of my title.
3. I have not been convicted of any felony of any nature, nor of any crime whatsoever which involves dishonesty, regardless of classification as misdemeanor or felony. (E.g. theft, robbery, fraud) In the alternative, I have disclosed such conviction(s) to the American Spirit Pageant national office for a determination as to my eligibility and accept their decision without question or argument. Failure to disclose this information may result in disqualification and relinquishment of my title.
General Code of Conduct
1. I understand and agree that whether I am a state pageant titlist or an “At Large” state delegate, during the term of my reign I am a representative of American Spirit Pageants and of my state and as such I will represent and promote ASP, my state, my title and my State Director (if applicable) in a positive light at all times.
2. If I am an “At Large” state delegate I understand and agree that a State Director may be approved by ASP at anytime during my reign and I agree to assist any such Director in any reasonable way possible to promote the pageant system within my state. I further acknowledge that although best efforts will be made to have my title reign last near to a year, I understand and agree that my reign may be shortened or extended if/when a State Director is approved for my state.
3. I understand and agree that whether I am a state pageant titlist or an “At Large” state delegate, I will make all reasonable efforts to make appearances on behalf of my title and to maintain a Facebook page and/or website blog assigned to me by my State Director and/or ASP. I understand that both, appearances and other communications are not only of benefit to ASP but to me as well. I will make reasonable efforts to take advantage of the networking opportunities afforded my title, understanding that I will only get out of it what I put into it. Appearances must be approved by ASP or my State Director (if applicable), and unless indicated otherwise in advance, travel and lodging expenses are at my own cost or will be borne by the persons securing my appearance. I agree not to make appearances where alcoholic consumption is the PRIMARY purpose of the event. If I am a minor I agree that I will never drink alcohol while acting as an ambassador of ASP or my state pageant. Whether a minor or not, I will never knowingly allow myself to be photographed drinking an alcoholic beverage while appearing in my capacity of ambassador of ASP or my state pageant. I will avoid making appearances as events, or for causes, that discriminate based on race, sex or religion. I agree to maintain a Facebook page and/or website blog with information about my past and upcoming appearances and my personal motivational insights.
4. I will conduct myself at all times with dignity, grace and good manners whenever I am wearing my crown and/or banner and while representing my State Pageant and/or ASP.
5. I understand that ASP and the various state pageants within the system distinguish themselves from other pageants in that charitable fundraising is a judged component in the competition. I agree to promote American Spirit Charities and whatever charity or cause it, ASP and/or my State Director supports. I understand that I am not excluded from promoting other platforms that may be important to me. But, I will serve in any way reasonable to promote the charity or cause directed by ASP.
6. I understand that as a state delegate and ambassador of ASP I am expected to comport myself at all times with utmost the utmost courtesy and good sportsmanship. Even though the pageant is a competition I understand that the most valuable prize is the experience of being a role model to others and an agent for good in my community. Therefore, I agree that I will NEVER engage in conduct or discussions which in any way disparage or defame ASP, the national competition, any state competitions within the system, other state titleholders, the National Director, any State Director, any staff or volunteer within the pageant system, or any judges. Any such actions or discussions will not be tolerated at any level. I will not engage in any negative innuendo that targets any of the above, not misrepresent myself or others with respect to ASP and the state pageants. I understand that the pageant producers take every reasonable precaution to ensure utmost fairness in the judging. I also understand that judging is a very subjective thing and not every judge will agree with each other, or necessarily with my views. However, I agree to abide by, respect and not question the judge’s results. I will not make disparaging remarks about the results or the pageant to anyone, nor post such remarks online. I agree to report any other delegate that does so to my State Director and/or ASP. Further, if I am married I will do my best to ensure that my spouse follows these rules as well. If I violate any of these prohibitions or rules, be it in writing, oral and/or by my actions I agree that I may be stripped of my title. Moreover, if I have received any prizes at a state pageant or the national pageant I will be required to return those. All archival evidence of my participation in the pageant shall be removed. Further, I hereby agree that ASP may, in its sole discretion, share with any other pageant system that I have been stripped of my title for violation of the sportsmanship clause. I understand that may have the effect of prohibiting me from participating in any other pageant system in the future. But, I understand how important maintaining good sportsmanship is, for the good of ASP and all the other participants, and therefore agree that a violation would be cause for the most severe sanctions. Lastly, if anything I do or say in violation of this clause rises to the level of defamation or breach of contract, I understand that ASP and/or my State Pageant may bring an action against me for damages. In that event I agree to submit to the jurisdiction of the Fourteenth Judicial Circuit, Rock Island County, Illinois and for this agreement to be construed according to the laws of Illinois. I agree that if I lose in such an action that in addition to a judgment, together with applicable interest, I will be responsible for paying reasonable attorney fees and costs associated with ASP pursuing the lawsuit.
7. I will not participate in any interview, photo session, press contact or publicity of any kind with reference to ASP or my State Pageant without prior approval from, or attendance by, staff or a director of ASP or my State Pageant. I will also instruct my family and friends or representatives to abide by this rule.
8.I agree to take all reasonable measures to make myself available to give up my crown to my successor at a state pageant, if applicable.
Code of Conduct at National Competition
1. I will observe the rules and regulations specific to the national competition from the time of my arrival for the American Spirit Pageants until my departure. I will register by the official time set and remain until released unless provided written authorization by the National Director.
2. I will identify my room number and emergency cell number to proper staff from ASP.
3. I will not participate in any interview, photo session, or engage in any press contacts or publicity of ANY KIND unless a member of the Pageant staff is present during the national competition week. I will not attend any function or make any public appearances other than at regularly scheduled events during the competition week. “Free time” is defined as time on my own, but may not be spent participating in prohibited activities.
4. I will not smoke nor consume alcohol in public during the Pageant week and I will conduct myself properly at public outings and during all times that I am visible to the public during Pageant week.
5. Neither I, not my family, friends or representatives will approach or be in the company of, a Pageant judge before or during the competition. At no time shall I, my family, friends or representatives question any judge as to opinions or comments regarding me, other delegates, scoring or the pageant in general.
6. I will not invite anyone backstage or onstage following preliminaries or finals during the Pageant, at any time except as announced by the National Director or Pageant staff. I will ensure that my family, friends and representatives abode by this rule as well so that the Pageant photographer and videographer can take official photos.
7. I will maintain a punctual time schedule in order for all phases of competition, including rehearsals, to run smoothly.
8. I will make no comments disparaging any judge, director, pageant staff, winner or other delegate or questioning the outcome of the pageant competition, as outlined in Paragraph 6 of the General Code of Conduct.
9. I agree to submit a Pageant Program Ad by the deadlines set forth by ASP. The advertisement shall comply with the formatting outlined by ASP, including a headshot. I may secure sponsors to offset the cost of the ad but agree that I am ultimately responsible for payment of the ad, which shall be ($750.00) seven hundred fifty dollars for a full page, color ad If available, I can secure the inside or outside back cover for ($2500.00) two thousand five hundred dollars. I also understand that failure to meet deadlines with respect to the program may result in my advertisement(s), sponsor list and/or headshot being omitted from the Official National Pageant Program Book.
10. I agree to stay in the hotel secured by ASP for the national competition and will be respectful of my neighbors and the hotel property.
11. I agree to participate in all National Pageant events.
Audio/Photo/Video
1. I grant to my state pageant (if applicable) and to ASP the right to use my name, image and/or performance for their use in any manner as deemed necessary to promote Asp or any state pageant within the system, without limit and without remuneration.
2. I hereby waive the right to approve the finished photograph(s) or any copy that might be used in conjunction with the finished photograph/product.
3. I understand that neither my state pageant (if applicable), ASP, or their assigns and successors, are responsible for the quality of the photography and videography of the state and/or national pageants or any appearances I make that may be filmed.
4. I hereby forever release and discharge my state pageant (if applicable)and ASP, and their assigns and successors from any claims, actions and/or damages whatsoever by reason of any such use.
Fees, Hold Harmless and Indemnity
1. I understand and agree that in order to participate in the national pageant I must have won a qualifying state pageant, or must be selected to fill a “At Large” berth. If I have been selected “At Large” then I agree that in order to participate in the National Pageant I must also pay all outstanding fees in full. Failure to submit final payments will result in my disqualification from competing and I will not be entitled to any refund of any amount previously paid. In fact, if I am unable to compete for ANY reason, I will not be entitled to any refund whatsoever.
2. I do hereby waive, release and forever discharge American Spirit Pageants, Inc., American Spirit Charities, Inc., all state pageant within the ASP system, their officers, agents, employees, representatives, executors, successors and assigns from any and all responsibilities, or liability, or damages, or accidents resulting from my participation in any Pageant activities. I do also hereby release all those mentioned, and any other acting on their behalf, from any responsibility or liability for any accident or injury to myself, including those caused by the negligent act or omission of any of those mentioned ot others acting on their behalf or in any way arising out of or connected with my participation in any activity related to the American Spirit Pageants or my state pageant (if applicable), including, but not limited to, public appearances and publicity events.
3. I agree to take full responsibility for any losses, damages, claims or debts incurred or made by myself or any member(s) of my party, in connection with my participation in the state and/or National pageant. These include, but are not limited to, the non-refundable registration fee, the costs of my clothing and out of pocket expenses and all personal property brought to the pageant and pageant related events.
Title Responsibilities
1. During my reign as State Queen in the ASP system I shall not compete in any other Pageant competition, be it preliminary, State or National without the express written consent of my state director (if applicable) AND ASP.
2. I agree to embrace and proudly promote the title, crown and banner until it is passed on to my successor.
3. I agree that if at some point my state has a State Director, I will work with the State Director to prepare for the National Competition. I understand and agree that the State Director will make all final decisions regarding hair, makeup, wardrobe, paperwork, etc and that my noncompliance may lead to the termination of my state title.
4. I agree to attend a minimum of 12 appearances during my reign.
5.I hereby release the State Director (if applicable), State Pageant, Pageant staff, ASP and their successors and assigns from any accident or injury incurred in travel to, from and/or during the state pageant, national pageant and/or any other pageant related events.
6. Should I be unable to meet my obligations as State Queen at anytime during my reign I agree that I will forfeit my state title, my state crown, my state banner and all prizes to the first Runner Up in order of selection and availability. If there are no runners up I forfeit all to the State Pageant, if applicable, otherwise to ASP.
7. Should I win a national title, I will not, during my reign, compete in any other Pageant competition, be it preliminary, State or National.
8. Should I win a National Title, I agree to embrace and proudly promote the title, crown and banner of my National Title, and will do so until the title is passed on to my successor.
9. Should I win the National Title, I agree to promote American Spirit Pageants to my fullest abilities and will attend at least six not-for-profit appearances during my reign, either locally or nationally, and inform the National Director PRIOR TO appearances.
10. Should I win a National Title at least once a week, I also agree to submit a written update of my community service, special activities, exciting moments, or simply inspirational experiences as part of being the new national titleholder for possible exposure on the national website. These updates will be submitted via e-mail in a WORD DOCUMENT attachment. National Director reserves the right to edit as needed.
11. Should I win the National Title, I agree to sign the Winner’s Agreement Form with more specific details including, but not limited to, appearances, expenses, and other items which may not have been outlined herein.
12. Should I win the National Title, and cannot meet the winner’s obligations listed herein, I will forfeit my National Title, my National crown, my National Banner and all my prizes to the Runner-Up in order of selection and availability.
13. If I am not chosen the National Winner, but place as a first Runner-Up, the National Title defaults to me, I must meet all eligibility requirements at the time of the default, and be bound the provisions of this agreement.
Miscellaneous
1. To the extent that any paragraph(s) within this agreement are found by a court of competent jurisdiction to be null, void and/or have no effect, any and all other paragraphs will be deemed fully applicable so as to effectuate the remainder of the agreements therein.
2. Any controversy arising out of, or relating to the Agreement shall be interpreted according to the laws of the State of Illinois, and proper venue shall the County of Rock Island. The prevailing party in any dispute shall be entitled to recover any damages incurred, costs and attorney fees.
I understand and agree that an electronically reproduced signature or initials is considered valid as the original. I will, however, also mail a duplicate original of my signature agreeing to the terms of outlined herein and agree, if necessary to execute another copy if/when I appear at the national competition.
Parents or Guardians of Minor State Delegate Prospects
As the parent/guardian of the above Prospective Delegate I hereby grant my permission for her to participate in the American Spirit Pageant system under the terms and conditions outlined above.
As the parent/guardian of the above Prospective Delegate I agree that if she is selected as a Delegate to hereby release and discharge American Spirit Pageants, Inc., American Spirit Charities, Inc., all state pageants within the ASP system, and any of their officers, employees, shareholders, staff, volunteers, representatives and assigns from any and all liability of any kind upon any claim or course of action, which might be asserted on behalf of said minor against the above listed.
Further, I to the extent that any of the above terms apply to family and friends of a Delegate I agree to abide by them. Moreover, I understand and agree that a parent or guardian’s love for a child can be very deep and profound and in my eyes my child is always a winner. However, I understand and agree that I will not question the decision of the judges. I will not, by my actions, oral or written words do anything to disparage ASP, any state delegates, any ASP State Pageants, any directors, staff or volunteers, or any judges, Nor will I in any other way exhibit poor sportsmanship with respect to the outcome of the Pageant. I will urge all other family member and friends to exercise the same courtesy and professionalism. I understand and agree that if I, or any other family members, friends or representatives fail to act in a courteous manner my child or ward may suffer the consequences described above in Paragraph 6 of the General Code of Conduct.
Furthermore, in the event of an accident, if pageant staff is unable to contact me, I hereby grant permission to said staff to administer necessary first aid and/or take Delegate to the nearest hospital or medical facility or additional treatment for which I assume all monetary responsibilities.
